Introducing a sociological perspective on judicial emotions, we argue that previous studies underemphasize structural and interactional dimensions. Through key concepts in the sociology of emotions we relate professional court actors’ emotion management to the emotional regime of the judiciary. Examples from the Swedish judiciary illustrate three main arguments: The idea of rational justice as nonemotional must be investigated as a joint accomplishment including collective emotion management; Judicial objectivity requires situated emotion management and empathy, orientated by emotions of pride/shame; The structural (...) dimensions of power/status mitigate feeling and display rules. The situated power of the judge is upheld by ritual deference from other court professionals. Concluding, we suggest topics to develop structural and interactional perspectives on judicial emotion. The dominant image of judicial authority is emotional detachment; however, judicial work involves emotion. This presents a challenge for researchers to investigate emotions where they are disavowed. Two projects, one in Australia and another in Sweden, use multiple sociological research methods to study judicial experience, expression, and management of emotion. In both projects, observational research examines judicial officers’ display of emotion in court, while interviews investigate judicial emotional experiences. Surveys in Australia identify emotions judicial officers generally find important in their (...) work; in Sweden, shadowing allows researchers to investigate individual judicial emotion experiences and expression. Evaluating the different methods used demonstrates the limitations and effectiveness of particular research designs, the value of multiple methods and the challenges for researching emotion. The aim of this study was to explore and interpret the diverse subject of positions, or roles, that nurses construct when caring for patients in their own home. Ten interviews were analysed and interpreted using discourse analysis. The findings show that these nurses working in home care constructed two positions: `guest' and `professional'. They had to make a choice between these positions because it was impossible to be both at the same time. An ethics of care and an ethics of (...) justice were present in these positions, both of which create diverse ethical appeals, that is, implicit demands to perform according to a guest or to a professional norm. The aim of this study was to explore metaphors for discovering values and norms held by nurses in home-based nursing care. Ten interviews were analysed and interpreted in accordance with a metaphor analytical method. In the analysis, metaphoric linguistic expressions and two entailments emerged, grounded in the conceptual metaphor ‘home-based nursing care is an endless journey’, which were created in a cross-domain mapping between the two conceptual domains of home-based nursing care and travel. The metaphor exposed home-based nursing care as (...) being in constant motion, thereby requiring nurses to adjust to circumstances that demand ethical maturity. The study focuses on the importance of developing further theories supporting nurses’ expressions of their experiences of everyday ethical issues. (shrink)

According to internalism about rationality, the ir/rationality of a subject depends only on how things appear from her subjective perspective. According to culpabilism, rationality is a normative standard such that violations of rationality are (at least sometimes) blameworthy. According to a classical line of reasoning, culpabilism entails internalism. I argue that, to the contrary, culpabilism entails that internalism is false. The internalist cannot accommodate the possibility of culpable irrationality.

One aim of this study was to explore the role, or subject position, patients take in the care they receive from nurses in their own home. Another was to examine the subject position that patients say the nurses take when giving care to them in their own home. Ten interviews were analysed and interpreted according to a discourse analytical method. The findings show that patients constructed their subject position as `safeguard', and the nurses' subject position as `substitute' for themselves. These (...) subject positions provided the opportunities, and the obstacles, for the patients' possibilities to receive care in their home. The subject positions described have ethical repercussions and illuminate that the patients put great demands on tailored care. (shrink)

This edited volume seeks to provide guidance on how we can approach questions of governing and agency--particularly those who endeavour to embark on grounded empirical research--by rendering explicit some key challenges, tensions, dilemmas, and confluences that such endeavours elicit. Indeed, the contributions in this volume reflect the growing tendency in governmentality studies to shift focus to empirically grounded studies. The volume thus explicitly aims to move from theory to practice, and to step back from the more top-down governmentality studies approach (...) to one that examines how one can/does study how relations of power affect lives, experience and agency. This book offers insight into the intricate relations between the workings of governing and (the possibility for) people's agency on the one hand, and about the possible effects of our attempts to engage in such studies on the other. In numerous ways, and from different starting points, the contributions to this volume provide thoughtful insights into, and creative suggestions for, how to work with the methodological challenges of studying the agency of being governed.This work will be of great interest to students and scholars of international relations, global governance and research methods. In this paper, we aim to show that a study of Gilbert Ryle’s work has much to contribute to the current debate between intellectualism and anti-intellectualism with respect to skill and know-how. According to Ryle, knowing how and skill are distinctive from and do not reduce to knowing that. What is often overlooked is that for Ryle this point is connected to the idea that the distinction between skill and mere habit is a category distinction, or a distinction in form. (...) Criticizing the reading of Ryle presented by Jason Stanley, we argue that once the formal nature of Ryle’s investigation is recognized it becomes clear that his dispositional account is not an instance of reductionist behaviorism, and that his regress argument has a broader target than Stanley appears to recognize. This paper seeks to chart a concept of historical experience that French Romantic writers first developed to describe their own relationship to historical time: the notion of the “transitional period.” At first, the term related strictly to the evolving periodic conception of history, one that required breaks, spaces, or zones of indeterminacy to bracket off periods imagined as organic wholes. These transitions, necessary devices in the new grammar of history, also began to attract interest on their own, conceived either as (...) chaotic but creative times of transformation, or, more often, as slack periods of decadence that possessed no proper style but exhibited hybrid traits. Their real interest, however, lies in their reflexive application to the nineteenth century itself, by writers and historians such as Alfred de Musset, Chateaubriand, Michelet, and Renan, who in their effort to define their own period envisioned the “transitional period” as a passage between more coherent and stable historical formations. This prospective self-definition of the “age of history” from a future standpoint is very revealing; it shows not just the tension between its organic way of apprehending the past and its own self-perception, but it also opens a window on a new and paradoxical experience of time, one in which change is ceaseless and an end in itself. The paper also presents a critique of the way the term “modernity” has functioned, from Baudelaire’s initial use to the present, to occlude the experience of transition that the Romantics highlighted. By imposing on the nineteenth-century sense of the transitory a heroic period designation, the term “modernity” denies precisely the reality it describes, and sublimates a widespread temporal malaise into its contrary. The paper concludes that the peculiarly “modern” mania for naming one’s period is a function of transitional time, and that the concept coined by the Romantics still governs our contemporary experience. Patient education materials have the potential to strengthen the health literacy of patients. Previous studies indicate that readability and suitability may be improved. The aim of this study was to explore and analyze discourses inherent in patient education materials since analysis of discourses could illuminate values and norms inherent in them. Clinics in Sweden that provided colorectal cancer surgery allowed access to written information and ‘welcome letters’ sent to patients. The material was analysed by means of discourse analysis, embedded in (...) Derrida's approach of deconstruction. The analysis revealed a biomedical discourse and a hospitality discourse. In the biomedical discourse, the subject position of the personnel was interpreted as the messenger of medical information while that of the patients as the carrier of diagnoses and recipients of biomedical information. In the hospitality discourse, the subject position of the personnel was interpreted as hosts who invite and welcome the patients as guests. The study highlights the need to eliminate paternalism and fosters a critical reflective stance among professionals regarding power and paternalism inherent in health care communication. (shrink)

Teleosemantics has an indeterminacy problem. In an earlier publication, I argued that teleosemanticists may afford to be realists about indeterminacy, pointing to the phenomenon of vagueness as a case of really-existing semantic indeterminacy. Here, I continue that project by proposing two criteria of adequacy that a semantically indeterminate theory should meet: a criterion of theoretical adequacy and a criterion of extensional adequacy. I present reasons to think that indeterminate versions of teleosemantics can meet these criteria. I end by discussing vagueness, (...) concluding that it most likely is not the same kind of phenomenon as the semantic indeterminacy afflicting teleosemantics. (shrink)

Just as we can be more or less certain that there is extraterrestrial life or that Goldbach’s conjecture is correct, we can be more or less certain about normative matters, such as whether euthanasia is permissible or whether utilitarianism is true. However, accommodating the phenomenon of degrees of normative certitude is a difficult challenge for non-cognitivist and expressivist views, according to which normative judgements are desire-like attitudes rather than beliefs. Several attempts have been made on behalf of non-cognitivism and expressivism (...) to meet the challenge Studies in metaethics, Oxford University Press, Oxford, 2007; Sepielli in Philos Stud 160: 191–207, 2012; Eriksson and Francén Olinder in Aust J Philos 94: 719–735, 2016). These attempts have all been found wanting. Michael Ridge has recently offered a quasi-realist solution, according to which expressivists can say exactly what cognitivists say about certitude, including normative certitude. In this paper, we explain the basic problem and Ridge’s quasi-realist solution. We then argue that the quasi-realist account of normative certitude faces severe difficulties that do not arise for cognitivist accounts, according to which normative judgements are beliefs. The genome editing technology CRISPR is described as a technological game-changer because of its flexibility and precision, and as an ethical game-changer due to its ability to engineer traits in living organisms without crossing species, avoiding a significant objection to genetically modified organisms (GMOs). In salmon farming, applications of CRISPR in breeding hold the promise of handling environmental and fish welfare challenges yet require social acceptance. Adopting an empirical bioethics framework, this stakeholder interview study shows that respecting species borders is (...) important, but not decisive, for acceptance among Norwegian stakeholders. The main objections are based on moral reflections about technology use and outcomes. These reflections combine principles and pragmatic deliberations of moral costs and benefits, suggesting that CRISPR applications with environmentally and ethically significant benefits can be socially acceptable. This indicates that the game-changing potential of CRISPR relies on the characteristics of the editing and the context in which the application takes place. (shrink)

In this essay, I distinguish two ways of depsychologizing psychology: ‘anti-psychologism’ and ‘non-psychologism’. Both positions are responses to the Fregean sharp distinction between the logical and the psychological. But where anti-psychologism, which I find in John McDowell, attempts to overcome the sharp distinction by arguing that psychological states and their expressions are apt to be articulated into judgments, Stanley Cavell's non-psychologism, a powerful and neglected alternative, wants to overcome the sharp distinction by abandoning judgment as the paradigm expression of thought (...) and communication. For us, narrative care is grounded in pragmatist philosophy and focused on experience. Narrative care is not merely about acknowledging or listening to people's experiences, but draws attention to practical consequences. We conceptualize care itself as an intrinsically narrative endeavour. In this article, we build on Lugones' understanding of playfulness, particularly to her call to remain attentive to a sense of uncertainty, and an openness to surprise. Playfulness cultivates a generative sense of curiosity that relies on a close attentiveness not (...) only to the other, but to who we each are within relational spaces. Generative curiosity is only possible if we remain playful as we engage and think with experiences and if we remain responsive to the other. Through playfulness, we resist dominant narratives and hold open relational spaces that create opportunities of retelling and reliving our experiences. Drawing on our work alongside older adults, as well as people who work in long‐term care, we show the possibilities of playfulness in the co‐composition of stories across time. By intentionally integrating playfulness, narrative care can be seen as an intervention, as well as a human activity, across diverse social contexts, places and times. (shrink)

Book review of Crary, Alice, Inside Ethics: On the Demands of Moral Thought, Harvard University Press 2016.

This thesis offers a teleosemantic account of moral discourse and judgment. It develops a number of views about the function and content of moral judgments and the nature of moral discourse based on Ruth Millikan’s theory of intentional content and the functions of intentional attitudes. Non-cognitivists in meta-ethics have argued that moral judgments are more akin to desires and other motivational attitudes than to descriptive beliefs. I argue that teleosemantics allows us to assign descriptive content to motivational attitudes and hence (...) that even if the non-cognitivist is correct, moral judgments can be said to describe the world. Moreover, given further teleosemantic assumptions, this conclusion has consequences that are both surprising and interesting. First of all, while moral judgments have descriptive content, moral statements do not. The purpose of moral discourse is not to convey beliefs that are true simpliciter, but to convey attitudes that are descriptively correct when tokened by the addressee. Consequently, moral discourse requires speakers to adapt to hearers in order to secure their assent and bring them into "community of judgment" with themselves. Secondly, the descriptive content of a motivational attitude is partly a matter of the subject’s own preferences and circumstances. In particular, the descriptive correctness of a moral judgment is partly a function of the degree to which it is shared with others. Since a moral judgment also motivates the subject to spread it, it has the ability to, in a certain sense, make itself true. If regular descriptive beliefs are supposed to adapt the subject to the world, a moral judgment also has the capacity to adapt the world to the subject. (shrink)

This article takes up the proposal that action and expression enable perceptual knowledge of other minds, a proposal that runs counter to a tradition of thinking that other minds are special in that they are essentially unobservable. I argue that even if we accept this proposal regarding perceptual knowledge, there is still a difference between knowing another person and knowing other things. I articulate this difference by pointing out that I can know another person by sharing knowledge with her. Such (...) sharing is expressed in the use of the second-person pronoun. Thus, I argue, other minds are indeed special as objects of knowledge, but not in the way the tradition has supposed. (shrink)
